Lunedì 24 maggio alle ore 11.00 si terrà la cerimonia di premiazione per vincitori dei 4 contest del REWF, Romaeuropa Webfacory. La cerimonia si terrà a Roma, presso l’Opificio Telecom, Via dei Magazzini Generali 20.
Il Romaeuropa Webfactory è un progetto congiunto tra la Fondazione Romaeuropa e Telecom Italia che intende raccogliere e sviluppare le esigenze e gli stimoli provenienti dalle nuove forme d’arte, generate o veicolate attraverso la rete nell’era del web 2.0.

Yesterday, 19th May, Italian senators discussed about the completions of the bill reforming the current regulation about interceptions, known as “The gag-law”.
The Senate’s Justice Commission’s go-ahead of yesterday is only a step in the process for making a bill into a law, but it’s a sign of how Berlusconi’s Government is going to regulate media: censoring them.
Let’s see how:
MAGISTRATES:
Interceptions, at the moment, are legal only in presence of serious evidence of crime and in the only case that they’re esteemed as fundamental elements for investigation.
Moreover, the public prosecutors can start interceptions only on the base of “specific investigation acts” on the base of concrete proofs that the person under investigation is guilty.
The Preliminary Hearing Judge’s approval is no longer enough: the interceptions must be permitted by the Court of the Region Capital.
MEMBERS OF PARLIAMENT:
Regarding to the Members of Parliaments, they can be intercepted only with the Chamber’s authorization. The rule is valid both to make interceptions on a member’s telephone and to use accidental interceptions made during the listening of someone else’s call.
PRIESTS (CATHOLIC CHURCH)
Despite the Opposition’s disagreement, item 1, paragraph 24, of the bill is passed.
The item prescribes that public prosecutors, in the event of an interception of a churchman, must immediately inform the Vatican through the Cardinal Secretary of State.
Nothing is written about jews, muslims, and so on.
THE PRESS
The measures about publishing have already passed, while the measures about journalism are going to be passed on Monday 24th May.
Editors must not publish the outcome of interceptions and investigations before the preliminary hearing takes place.
Punishment: the imprisonment and a fine with an amount ranging from 64.500 to 464.700 euro.
It’s also forbidden to simply investigation acts that are not considered anymore as confidential.
The measure called ‘D’Addario’ prescribes that recording of conversation pieces and filming in the courtrooms are forbidden unless everybody assent.
Fraudulent recording and filming are punishable (prison for 6 months to 4 years)
The Senators will meet again next Monday to enact the measures about journalists that prescribes a 2 month-arrest or a fine with an amount ranging from 2.000 to 10.000 euro for those who publish acts or documents of criminal proceedings until the beginning of the trial.
It’s possibile, moreover, the temporary removal from the list of Qualified Journalists.
Stefano Rodotà (an italian political and jurist, Professor and visiting Professor at a number of Universities around the World; one of the Creator of the Charter of Fundamental Rights of the European Union, former President of the Italian Personal Data Protection Authority ) created the page ‘No gag’, that at the moment collects about 76000 signatures; the Facebook group “Freedom is partecipation and information” that at the moment counts about 45.600 members.
Another group, “Public Resistance against the interception bill” has been created on facebook by Alessandro Tauro.
Repubblica, the first italian newspapers, asks the readers to send an e-mail containing a picture of them ”against the bill on the interceptions” ( nobavaglio@repubblica.it)
Other important subscription lists have been opened on the site of the Editors Laterza and in that of the Association Articolo 21.
The National Federation of the Italian Press has announced a general mobilization and a journalists’ strike.
FNSI’s Secretary Franco Siddi said:
“The interception’s bill is a dark page of our history. We’re going to do anything we can to cancel it. The journalists’ syndacate will hold out unrelentingly”.

Magistracy will have no chance in the future to fight illegality and scandals like the recent medical and financial ones.
Berlusconi says his aim is to safeguard Privacy but the real risk is to obtain just a dangerous regime.
By now, the law reform establishes that wiretaps are fundamental for the continuation of investigations and can be done on condition that the Court of the Region Capital upholds the request and that subsists the circumstancial evidence of a crime. For weighty crimes (for example, the involvement in criminal organizations such as Mafia of the person under investigation), a ‘reasonable suspicion’ of crime is enough to enable the legal authorization for the listening.
The Government’s legislative decree, bearing the signature of the Justice Ministry Angelino Alfano (Berlusconi’s party), must be approved by the Senate, the Parliament and, at the end, by the President of the Republic.
If the decree will be law, public prosecuters can start the interceptions not only “on the base of serious suspicions”, but “on the base of specific investigation acts” that prove the liability of the person under investigation or of third parties.
The amendment has been criticized by the all the most important italian magistrates, because of its reference to article 192 of the Civil Code, concerning the examination of the evidence: this will imply, for the public prosecutors, the statutary compliance of obtaining support against the person inquired even before requesting the interception, which should, instead, be the source of the conclusive evidence.
Moreover, the decree prohibits:
– the lecture of telephone attendance notes, in the absence of a pre-existing evidence of guilt,
-the use of bugs, unless the public prosecutor is absolutely sure that a crime is going to be committed in a certain place.
The legislative decree has been told to be created to protect citizens’ privacy rights, but the opposition parties (PD and IDV) assert that the restraints on interceptions provided in the amendment can make even more difficult the search for Mafia fugitives.
With regards to this argument, Donatella Ferranti (PD party) claimed the majority to distance itself from the italian undersecretary Daniela Santanché statements on air on the italian television: she told that recording telephone conversations between criminals and their families is a privacy violation.
The editors Giuseppe Laterza and Stefano Mauri, on the occasion of the Turin’s International Book Fair, made a plea against the Government’s legislative decree.
The appeal, signed by many Italian editors, has been critized by the the editorial manager of Einaudi, Ernesto Franco, who said: “This signature collection is only marketing. It’s useless for the press freedom“.
The different point of views have engendered what has already been defined as ”the editors’ war“.
The protest against the bill is spreading through social networks.
Stefano Rodotà (an italian political and jurist) created the Facebook group “Freedom is partecipation and information” that, by now, counts about 36.600 members.
In Rodotà’s opinion, the reform of the interception law would demolish the basis of the constitutional system.
“Freedom of expression and citizens’ information rights are put in jeopardy. A heavy censorship could affect the Information. Also the one, not professional, spread through the blogs (article 28).
[…] They said they want to protect citizens’ Privacy: a rightful aim, that can be reached without violations of principles and rights.
The truth is that they want to impose a system made of opaqueness and secrecy. Constitutional freedom is not avaiable for the majority” (the text of the plea).

Il portavoce della Casa Bianca Robert Gibbs, ad esempio, la scorsa settimana ha utilizzato il suo nuovo account twitter per diffondere un articolo dell’Associated Press sulla divisione in due agenzie del Minerals Management Service, l’agenzia federale che gestisce il gas, il petrolio e le altre risorse minerarie degli Stati Uniti.
Lo stesso account è stato utilizzato, a marzo, per lanciare la notizia che Obama avrebbe rimandato le sue visite in Indonesia e Australia per lavorare sulla riforma sanitaria.
In occasione della nomina di Elena Kagan a procuratore della Corte Suprema USA, l’annuncio è stato dato tramite un video prodotto internamente e un’intervista postata sul blog della Casa Bianca.
Lo scorso mese, la Casa Bianca ha addirittura etichettato come ‘servizio esclusivo’ il video di Michelle Obama in visita ad Haiti per sondare i danni del terremoto, commentato dalla voce fuori campo di Barack.
I filmati hanno scatenato proteste da parte dei giornalisti che si occupano della Casa Bianca: ad esempio Josh Gerstein, corrispondente alla Casa Bianca per Politico.com, ha detto che la dipendenza dai new media “sta creando un forte di risentimento tra i giornalisti ‘vecchia scuola’” e ha aggiunto che “nel tempo, quel risentimento può crescere, e, durante una crisi, può verificarsi il caso che la Casa Bianca non abbia lo stesso livello di credibilità o rispetto da parte di quei giornalisti che sentono di essere stati intenzionalmente tagliati fuori dal cerchio”.
E Andrea Mitchell, del canale tv MSNBC, ha recentemente affermato on air che la Casa Bianca con il video sulla Kagan stava “oltrepassando i limiti”.
Davanti alle accuse, la Casa Bianca si difende affermando che il proprio ufficio stampa tenta solamente di rilasciare informazioni in modo quanto più diretto ed efficiente possibile.
Ma nel frattempo Obama, scrive Fox News, non ha tenuto una sola conferenza stampa in piena regola dallo scorso luglio, quando ha riunito i giornalisti alla Casa bianca per discutere la riforma della sanità, tanto che Ed Chen, Presidente dell’Associazione dei corrispondenti per la Casa Bianca, ha avuto un incontro con il portavoce Gibbs per chiedere una maggiore esposizione da parte del Presidente.
Volendo fare un resoconto dei rapporti fra la stampa e Obama durante il suo primo anno in carica, si può dire che Obama sotto certi punti di vista si è aperto alla stampa, sotto altri se ne è difeso.
Secondo una ricerca di Martha Joynt Kumar della Towson University (Maryland), Obama, nel suo primo anno di mandato, avrebbe avuto solo 47 brevi sessioni di q&a con i giornalisti: non molte rispetto alle 147 del Presidente Bush e alle 252 di Clinton nello stesso periodo.

Nel nostro precedente post, abbiamo analizzato il comportamento della BP su Internet, sottolineando come, dal punto di vista informativo, l’azienda sia sia comportata bene, o almeno molto meglio di tante altre che si trovano improvvisamente in stato di crisi.
La responsabilità del disastro ambientale del Golfo del Messico oggi è sulle spalle di tre aziende: la BP, che gestisce il pozzo, la Transocean, proprietaria della piattaforma di trivellazione off-shore e la Halliburton, una società di Houston responsabile dei lavori sulla piattaforma. Anche se martedì, queste tre società hanno cercato di scaricare le proprie responsabilità tecnica l’una sull’altra, al Congresso USA, è evidente che sarà la sola BP a dover gestire il grosso crollo di reputazione sul mercato.
E intanto Obama afferma: “Mai sprecare una crisi”, affermazione che contiene espliciti attacchi alle società petrolifere rilanciando le riforme ambientaliste, aprendo quindi ufficialmente una stagione che si rivelerà particolarmente ostile per le compagnie petrolifere.
PR ITALIA ha chiesto a Gian Paolo Gironda, esperto in comunicazione di crisi, cosa ne pensa.
PR ITALIA: Secondo lei la lobby del petrolio, oggi attaccata duramente e pubblicamente, si limiterà a diventare più aggressiva nelle sedi istituzionali (lobby) oppure svilupperà anche una comunicazione maggiormente orientata ai consumatori?
GIRONDA: Vorrei fare una premessa sulla lobby del petrolio e la posizione di Obama. “Mai sprecare una crisi” è un tema da Obama già sviluppato in precedenza, per esempio in occasione di Katrina, ed è un principio primo in situazioni di crisi.
Ogni crisi porta con sé contenuti o elementi di opportunità. Obama può cavalcare l’emotività pubblica su un disastro immane per accelerare il suo disegno di legge: in presenza di un disastro drammatico, il suo processo di legge può essere approvato e può essere attivato un atteggiamento più rigido verso le industrie.
Ricordiamoci che Obama aveva autorizzato le trivellazioni marine, aumentandone il numero anche perché per gli americani costituiscono una fonte importante, non sostituibile con energie alternative.
Ora per regolamento bisogna essere più rigidi nei controlli e nei sistemi di sicurezza tenendosi lontani dalle coste. Come reagiscono le società petrolifere? Spesso, come nel caso di BP, con errori e scrollamenti di responsabilità, giocando allo scaricabarile. Nello specifico è evidente che non abbia funzionato qualcosa nella progettazione e nei criteri e principi di sicurezza.
GIRONDA: Non facciamoci illusioni. Nel recente caso del naufragio di Erika, di cui era responsabile Total, i consumatori francesi hanno per un po’ boicottato l’azienda, ma è durato poco. Lo stesso accadrà anche per i consumatori americani: finita l’onda emotiva, si dimentica, anche se sussisterà una parte marginale della popolazione che continuerà a non consumare BP.
Ciò che non è marginale, invece, è che le aziende coinvolte non stanno facendo nulla, stanno solo aggravando la situazione: il rimpallo delle responsabilità non fa certo intuire che alla base del loro lavoro ci fosse cordinamento, consapevolezza e responsabilità sociale. I tentativi di chiudere la falla stanno dimostrando vaghezza e impreparazione. Lo stesso appello diffuso dalla BP per raccogliere nuove idee (è stato aperto uno specifico sito web, ndr.), non è stato sfruttato:
PR ITALIA: Se lei fosse a capo della comunicazione di BP, quali strumenti e quali linee guida metterebbe in azione?
GIRONDA: Beh, sarei in difficoltà.
Sinceramente su questo posso fornire solo impressioni, non avendo strumenti interni per giudicare l’operato della BP. Tuttavia da quel che è emerso, posso dire che comportamenti e azioni della BP hanno dimostrato una gestione di crisi non efficace.
Per questa situazione di crisi si deduce che non si stata fatta una preliminare e seria Risk Analysis, che avrebbe comportato la predisposizione di interventi strutturali in grado di abbattere la probabilità di accadimento di una crisi. Se il problema che scatena la condizione di crisi non è stato previsto, se non vi è stato alcun progetto preliminare, gestire la crisi diventa un arrampicarsi sui vetri.
Se fossi a capo della comunicazione di BP, non solo chiederei scusa al mondo, ma ascolterei quelle aziende – come ad esempio quella italiana che ho citato – che si fanno vive per dare una mano.
Alcune situazioni sono talmente gravi che è difficile venirne a capo.
A parte mettere in campo le regole base che costituiscono le prime pagine del Decaloco del Gestore di Crisi (ammettere l’errore, chiedere scusa, promettere un risarcimento economico), dal punto di vista della comunicazione purtroppo si può fare ben poco.
